1. GENERAL PROVISIONS
1.1. This donation agreement to the project the Ark through the website (hereinafter “Website”) is made between:
The Beneficiary, the project the Ark (hereinafter “the Ark”) and
The Donor (hereinafter “Donor”), collectively referred to as “Parties”, regarding the donation to the project the Ark (hereinafter “Donation Agreement”).
1.2. The Donor can be any legally capable individual who has reached the age of majority.
1.3. Acceptance of the Donation Agreement by checking the box and making a donation means full agreement of the Donor with the terms of the Donation Agreement.
1.4. The Ark is ready to conclude donation agreements in a different manner and/or on other terms than those provided in this Donation Agreement. To make a donation on different terms, an interested party can contact the Ark via email: [email protected].

2. TERMS OF MAKING A DONATION
2.1. The Donor, as a voluntary charitable donation, transfers their own funds to the Ark by any means available on the Website, and the Ark accepts the charitable donation and undertakes to use it to achieve the goals of the Ark’s activities.
2.2. The Donor independently determines the amount of the donation.
2.3. The Donor undertakes to use a payment method that belongs to them (registered in their name).
2.4. Before making a donation, the Donor must enter their name and email on the donation page of the Website, as well as accept the User Agreement and the Donation Agreement.
2.5. By making a donation, the Donor confirms that they have read the Privacy Policy and agree that their data will be processed as stated in the Privacy Policy.
2.6. The Donor guarantees that the donated funds belong personally to them, were obtained legally, and undertakes to confirm this fact at the first request of the Ark.
2.7. The Donor has the right to receive information about the use of their donation.
2.8. Donations are non-refundable.

3. ACTIVITIES OF THE ARK
3.1. The Ark is engaged in organizing free assistance to Russians with an anti-war stance in Russia and abroad.
3.2. The activities of the Ark are not aimed at making a profit.
3.3. The organization publishes information about its work and reports on its activities on the website https://kovcheg.live/.
3.4. The Ark processes the personal data of the Donor as stated in the Privacy Policy.

4. APPLICABLE LAW AND DISPUTE RESOLUTION
4.1. All requests related to the interpretation, validity, and performance of this Agreement are governed, interpreted, and applied in accordance with the laws of the country where the Ark is located.
4.2. In case of any disagreements or disputes between the Parties, it is mandatory to file a claim (a written proposal for voluntary dispute resolution) before going to court.
4.2.1. Claims to the Ark can be sent:

4.2.2. The recipient of the claim within 30 calendar days from the date of its receipt, will inform the claimant in writing about the results of the consideration of the claim.
4.3. If it is impossible to resolve the dispute voluntarily, either Party may apply to the court at the location of the Ark.
4.4. If permitted by applicable law, the Donor agrees that they can bring claims against the Ark only in their own name, and not as a plaintiff or member of a class in any class action.

5. SEVERABILITY OF TERMS
If any provision of the Donation Agreement is deemed invalid or unenforceable under any law, ordinance, regulation, or decision of a competent authority, such provision shall be deemed amended or excluded only to the extent necessary to comply with such ordinance, regulation, or decision, while the remaining provisions remain fully effective.

6. AMENDMENTS TO THE DONATION AGREEMENT
The Ark may unilaterally make changes to the Donation Agreement without notifying the Donor. The current version will be published on the Website.
